Adoption

We can handle all types of private adoptions including step-parent adoptions, adoptions by relatives and non-relative adoptions.  An adoption begins with filing a petition for adoption in the circuit court in your county of residence, obtainging the  appropriate consent from the birth parent or parents and submitting a number of forms to the Oregon Department of Human Services.  It is a long process that you can expect to take three to six months.

 

Some issue to consider include:

 

Consent.

 

The birth parents must consent to an adoption. If the birth parents object they must be proven unfit for the court to grant an adoption over their objection.  This generally requires clear and convincing evidence that the parents “willfully deserted the child or neglected without just and sufficient cause to provide proper care and maintenance for the child for one year..." ORS 109.324(1).  If the birth parents do consent the consent must be in writing in the correct form and they must be given the opportunity to participate in pre-adoption counseling at the adoptive parent's expense.

 

Depending on the circumstances, the consent of a birth father may not be necessary.  This can be a tricky question and depends on several factors including whether paternity has been established and whether the father has made an effort to have contact with the child or provide support. 

 

Home Study.

 

Generally prospective adoptive parents must submit a fairly comprehensive home study to the Oregon Department of Human Services.  The home study is usually done by an independant agency or individual that is certified by the state. Home studies can be expensive and significantly add to the overall cost of the adoption.  Depending on the circumstances you may qualify for a waiver of the home study.  We can help you determine whether a home study will be required and assist you in getting it set up and completed.
